Chargeback Policy: You agree that once the services outlined above have been rendered, you will not initiate a chargeback with your credit card company. You understand that a chargeback can harm our business and reputation. If you have any concerns or disputes regarding the services provided, you agree to first contact us directly in writing within three business days of the service completion to discuss and attempt to resolve the issue in good faith. We are committed to working with you to reach a fair and mutually agreeable resolution.
Dispute Resolution Process: In the event of a dispute, you agree to the following process:
Written Notice: You must provide us with a written notice detailing the nature of your complaint within three business days of the service completion.
Good Faith Negotiation: Both parties agree to engage in good faith negotiations to resolve the dispute within three business days of receiving the written notice.
Mediation (Optional): If the dispute cannot be resolved through negotiation, both parties may agree to pursue mediation. The cost of mediation will be shared equally between both parties.
Arbitration (Optional): If mediation is unsuccessful (or if both parties do not agree to mediation), both parties may agree to binding arbitration. The rules of the chosen arbitration organization will govern the process. The cost of arbitration will be shared equally between both parties.
Exceptions: This Chargeback Policy does not apply in cases of demonstrable fraud or if the services above were not provided as agreed upon. In such cases, you may pursue other remedies available to you under applicable law.
Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior negotiations and agreements, whether written or oral.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
